Understanding abuse
Abuse Is Not Always Physical
Abuse can take many forms, and it is not always easy to recognize—especially when it occurs gradually or comes from someone you love and trust.
Under the Violence Against Women Act (VAWA), abuse can include physical violence, sexual abuse, threats, intimidation, emotional or psychological harm, controlling behavior, forced isolation, or the use of your finances, children, or immigration status to scare or control you.
You might be experiencing abuse if someone:
- It physically hurts you or threatens to harm you.

¿Who qualifies for the VAWA Program?
- 1. Mistreatment or violence: You must have been a victim of physical, emotional, or psychological abuse, or extreme cruelty, by your spouse, parent, or child who is a U.S. citizen or permanent resident.
- 2. Relationship with the aggressor: The abuser must be a U.S. citizen or a lawful permanent resident (green card holder), and you must be their spouse, child, father, or mother.
- 3. Residence or cohabitation: You must have lived with the abuser at some point. In certain cases, people who no longer live with the abuser may also qualify.
- 4. Good moral character: You must demonstrate that you are a person of good moral character, which generally means not having criminal records that disqualify you.
- 5. Self-petition: The VAWA program allows you to file a self-petition for immigration relief without the need for the abuser to participate in the process.
VAWA focuses on protecting you, not punishing your abuser.

The Violence Against Women Act (VAWA) is a federal law that allows certain immigrant victims of abuse by a family member who is a U.S. citizen or legal permanent resident to file a "self-petition" for immigration status without the knowledge or consent of the abuser.

- The spouse (current, divorced, or widowed) of a U.S. citizen or green card holder who abused you.
- The child of a U.S. citizen or green card holder who abused you.
- The parent of a U.S. citizen (21 or older) who abused you.
- Demonstrate a qualifying relationship and that the abuser is or was a U.S. citizen or permanent resident.
- Prove that you lived with the aggressor at some point.

Yes. Immigration agencies cannot disclose information about your case or take action based solely on information provided by the abuser.
No. The approval recognizes you as a self-petitioner. You still need to complete the adjustment of status process when a visa becomes available.
Many applicants qualify for an Employment Authorization Document (EAD) once they submit their petition or have a pending Form I-485.
