Who Qualifies for VAWA Program
- 1. Abuse or Violence: You must have been the victim of physical, emotional, or psychological abuse, or extreme cruelty by a U.S. citizen or permanent resident spouse, parent, or child.
- 2. Relationship to the Abuser: The abuser must be a U.S. citizen or lawful permanent resident (green card holder), and you must be their spouse, child, or parent.
- 3. Residency or Entry: You must have lived with the abuser at some point, or in certain cases, applicants not currently living with the abuser may still qualify.
- 4. Good Moral Character: You need to demonstrate that you are a person of good moral character, which generally means no disqualifying criminal history.
- 5. Self-Petitioning: The VAWA program allows you to self-petition for immigration relief without needing the abuser's involvement.

The Violence Against Women Act (VAWA) is a federal law that allows certain immigrant victims of abuse by a U.S. citizen or lawful permanent resident family member to “self‑petition” for immigration status without the abuser’s knowledge or consent.
You may qualify if you are:
- The spouse (current, divorced, or widowed) of a U.S. citizen or green card holder who abused you.
- The child of an abusive U.S. citizen or green card holder.
- The parent of a U.S. citizen (21 or older) who abused you.
- Show a qualifying relationship and that the abuser is/was a U.S. citizen or permanent resident.
- Show that you lived with the abuser at some point.
- Prove the marriage (if applicable) was in good faith.
- Show you suffered battery or extreme cruelty and have good moral character.
Includes physical violence, sexual abuse, threats, stalking, isolation, financial control, or severe emotional abuse.
Yes. Immigration agencies cannot disclose information about your case or take action based solely on information from the abuser.
No. Approval recognizes you as a self-petitioner. You must still complete the adjustment of status process when a visa is available.
Many applicants qualify for an employment authorization document (EAD) once they file or have a pending Form I-485.
VAWA has special rules that may allow adjustment of status despite entry without inspection if other requirements are met.
